Harris County Probate Attorney
Probate is a county matter. Texas files a case in the county where your loved one legally resided, not where the property sits and not where the family lives now, so for most Houston families the answer is Harris County and the five statutory probate courts downtown. Why the county decides your case
Under Texas Estates Code Section 33.001 probate is filed in the county where the decedent was domiciled. That single rule decides which courthouse, which judge, which local procedures, and how long the case takes. It is also why an address two streets away can send a neighbour to a different court, which is exactly what happens on the edges of this county.
Harris County runs five statutory probate courts, more than any other county in Texas. That is a genuine advantage: dedicated probate judges hearing probate all day, and cases that move on a predictable schedule when they are prepared correctly. The five Harris County probate courts
Cases are assigned at filing, so you do not choose your court. Each judge runs their docket a little differently, and knowing those differences before you file is most of the job.

Harris County is large, and the communities on its edges do not stop at the line. Katy sits across Harris, Fort Bend and Waller. Kingwood is split between Harris and Montgomery, with the boundary running diagonally through the neighbourhood. The northern edge of Spring is Montgomery County even though the mail says Spring. Families in those areas are routinely surprised, and filing in the wrong county can get a case transferred while deadlines keep running.
We confirm the correct county before anything is filed, and we handle the case either way. Texas probate runs on one statewide Estates Code, so the same process and the same flat fees apply whether your case belongs in Harris, Fort Bend, Waller, Montgomery, Galveston or Brazoria County.
